{"id":784,"date":"2022-08-16T07:52:58","date_gmt":"2022-08-16T07:52:58","guid":{"rendered":"https:\/\/arendus.magilex.ee\/?p=784"},"modified":"2023-02-16T06:52:55","modified_gmt":"2023-02-16T06:52:55","slug":"toolepingu-vorm","status":"publish","type":"post","link":"https:\/\/www.magilex.ee\/en\/toolepingu-vorm\/","title":{"rendered":"Employment contract form"},"content":{"rendered":"<p class=\"p1\">When concluding an employment contract, the employer may have a question as to whether the employment contract must necessarily be concluded in writing or whether an agreement concluded verbally or by e-mail, for example, is sufficient.<\/p>\n<p class=\"p1\"><span class=\"s1\">Eesti Vabariigis reguleerib t\u00f6\u00f6lepingu alusel t\u00f6\u00f6tamist peamiselt t\u00f6\u00f6lepingu seadus, mis n\u00e4eb muuhulgas ette ka t\u00f6\u00f6lepingu s\u00f5lmimise vormin\u00f5ude.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<h2 class=\"p3\"><span class=\"s3\">Kas t\u00f6\u00f6leping peab olema s\u00f5lmitud kirjalikult?<\/span><\/h2>\n<p class=\"p1\"><span class=\"s1\">Vastavalt\u00a0<a href=\"https:\/\/www.riigiteataja.ee\/akt\/13319829?leiaKehtiv\" target=\"_blank\" rel=\"noopener\">t\u00f6\u00f6lepingu seadusele<\/a>\u00a0peab t\u00f6\u00f6leping olema \u00fcldjuhul s\u00f5lmitud kirjalikult.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Kirjaliku lepingu s\u00f5lmimise vormin\u00f5uet ei kohaldata vaid juhul, kui t\u00f6\u00f6lepingu kestus ei \u00fcleta kahte n\u00e4dalat. Siiski soovitame hlisemate arusaamatuste v\u00e4ltimiseks t\u00f6\u00f6lepingu s\u00f5lmida ka juhul, kui vormin\u00f5uet ei kohaldata.<\/span><\/p>\n<h2 class=\"p3\"><span class=\"s3\">Mida t\u00e4hendab t\u00f6\u00f6lepingu kirjalik vorm?<\/span><\/h2>\n<p class=\"p1\"><span class=\"s1\">Tsiviilseadustiku \u00fcldosa seaduse kohaselt t\u00e4hendab kirjalik vorm seda, et kui seaduses on s\u00e4testatud tehingu kirjalik vorm, peab tehingudokument olema tehingu teinud isikute poolt omak\u00e4eliselt v\u00f5i digitaalselt allkirjastatud.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Seega peab t\u00f6\u00f6leping olema s\u00f5lmitud kas paberkujul ja allkirjastatud omak\u00e4eliselt v\u00f5i siis elektrooniliselt ja allkirjastatud digitaalselt.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<h2 class=\"p3\"><span class=\"s3\">Mis juhtub, kui t\u00f6\u00f6leping ei ole kirjalikult s\u00f5lmitud?<\/span><\/h2>\n<p class=\"p1\"><span class=\"s1\">T\u00f6\u00f6lepingu vormin\u00f5ude j\u00e4rgimata j\u00e4tmine ei too endaga automaatselt kaasa t\u00f6\u00f6lepingu t\u00fchisust ehk t\u00f6\u00f6leping loetakse s\u00f5lmituks ka juhul, kui t\u00f6\u00f6lepingut ei ole kirjalikult vormistatud, kuid t\u00f6\u00f6taja asub tegema t\u00f6\u00f6d, mille tegemist v\u00f5ib vastavalt asjaoludele eeldada \u00fcksnes tasu eest.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">T\u00f6\u00f6lepingu vormin\u00f5ude t\u00e4itmata j\u00e4tmine v\u00f5ib enaga kaasa tuua rahatrahvi t\u00f6\u00f6andjale, kuid v\u00f5ib negatiivseid tagaj\u00e4rgi omada ka t\u00f6\u00f6tajale.
